Booking Agreement and Responsibilities
Once you confirm a booking, you enter into a legally binding contract with us. By making a reservation, you explicitly agree to our terms and conditions.
Primary Responsibility
The person named on the Booking Form assumes full responsibility for ensuring that all members of the party adhere to the Conditions of Let. This means you will be the primary point of contact and accountable for the conduct of everyone in your group during the stay. Specifically, you agree to:
- Communicate our terms to all party members.
- Ensure adherence with all stated conditions.
- Take responsibility for any breaches by your group.
By proceeding with the booking, you acknowledge and accept these terms.
Guest Agreement
Our guests agree to the following:
1. A completed booking form, agreed upon by both parties, constitutes a binding contract. Any subsequent amendments must be mutually agreed upon in writing by both parties.
2. Maximum Occupation. The maximum number of guests at Craig is limited to four for liability reasons. This limit includes children and babies, as we treat every child, regardless of age, as a guest in our property. You may bring up to three dogs, provided you agree it with us in advance. For the first two dogs, you must pay a fee of £20 each per stay. The fee for the third dog is waived.
Extra Guests. Please refrain from bringing extra guests. This situation can make us appear inhospitable and ungracious. We reserve the right to ask the whole group to leave, without refund If this number is exceeded with no prior knowledge. If you plan to have a larger party, please contact us in advance to discuss your booking.
3. Payment terms. We require you to pay a 25% deposit when you book your holiday. You must pay the remaining balance 6 weeks before your holiday start date. If you make a booking less than 6 weeks before your holiday begins, you must pay the full balance at the time of booking. Should you fail to make payment by the specified due date, we may cancel your booking. We will then re-advertise Craig as available for new bookings.
4. Arrival/Departure Times – Guest arrival is scheduled for 4:00 PM. This timing allows us to clean and prepare Craig for your holiday. You are welcome to leave your luggage earlier and return later. On your departure day, you must vacate the property by 10:00 AM to give us time to prepare for the next guests. If you do not vacate on time, you may incur a minimum penalty charge of £25, or more, depending on the level of inconvenience caused to the owners or incoming guests.
5. Cancellation. Cancellation Policy
Guests must, in the first instance, notify us of any cancellation in writing and pay any monies due.
Cancellation and Rebooking Process
If you must cancel your holiday before arrival, we will:
- Always attempt to rebook your holiday dates
- Refund your money once a new booking is secured and payment is received
- Deduct a handling charge of £40.00 per week/shorter stay
- Subtract any incurred bank charges
Refund Scenarios
- If we re-let the accommodation at the full rate:
- We will provide a full refund
- Minus an administration fee of £40.00 per week
- If we re-let at a lesser rate:
- We will issue a partial refund
- If we cannot re-let:
- No refund will be provided
Cancellation Within 14 Days
- If you cancel less than 14 days before your start date:
- And we successfully re-let all of your holiday: Full refund minus £40.00 administration fee.
- If we only partially re-let: You remain responsible for the difference.
- If we cannot re-let: You are responsible for the full cost.
Insurance Recommendation
We strongly recommend cancellation insurance to safeguard against potential charges. While we do not provide insurance, we urge guests to consider holiday insurance, which is relatively inexpensive compared to the total holiday cost.
Owner Cancellation Policy
If we are unable to accept a booking:
- Your deposit will be returned.
- We reserve the right to refuse or revoke bookings we deem unsuitable.
- We are not obligated to provide a reason or enter into correspondence.
- If Craig becomes unavailable, our liability is limited to repaying monies already paid.
7. We are pet friendly
We warmly welcome well-behaved, house-trained pets with some important guidelines:
Pet Conduct and Responsibilities
- Keep your pets under strict control at all times
- Accept full liability for any damage your pets may cause
- Do not leave pets alone in the property or garden under any circumstances
- Pets are strictly prohibited from sitting on furniture
Cleaning Requirements
Upon departure, guests must:
- Thoroughly remove all pet hairs from carpets and furniture
- Promptly clean up any pet fouling in the gardens
By following these guidelines, you’ll help ensure a pleasant stay for both current and future guests.
8. Security and Responsibility
Guests are responsible for ensuring the property is secure by closing all exterior doors and appropriate windows when sleeping or absent. Additionally, all vehicles are left at the guest’s risk, and any personal property is solely the responsibility of the guests occupying the property.
Liability and Conduct.
Guests agree to absolve the property owner of any responsibility for accidents or mishaps to persons or property while on the premises or engaged in any activity there. This includes any illness or injury arising from any cause whatsoever. Moreover, guests must use the property solely for its intended purpose as self-catering accommodation. Guests also agree to accept the owner’s right to refuse entry to anyone deemed unsuitable to take charge. Furthermore, causing a nuisance or disturbance, including unreasonable behaviour, may result in the manager asking guests to leave.
9. Breakages, Damage, Losses, and Cleaning Responsibilities
Guests must respect and care for the accommodation during their stay, which includes leaving the property clean and tidy. If you break, damage, or lose something, please inform us immediately. We typically do not charge for accidental breakages, but we appreciate advance notice, especially given Craig’s location. This allows us to replace items before the next guests arrive.
Specific Conditions.
- We require reimbursement for soaked or damaged mattresses.
- If the property is left in an untidy condition, the owner reserves the right to apply a discretionary cleaning charge.
- The minimum cleaning charge is £80, which will be at the manager’s discretion.
- Guests are responsible for minimizing fire risk during their stay.
By communicating promptly about any incidents, you help us maintain the property’s quality and ensure a smooth experience for future guests.
10. Access to Property/Maintenance – Guests agree to allow the owners access to the property and garden at all reasonable times. The owners may, on rare occasions, perform routine or garden maintenance during your stay, but they will always discuss and agree this with you in advance.
11. Holiday Let General Conditions – Guests agree to use the holiday property solely as holiday accommodation, in accordance with Section 12(2) and paragraph 8 of Schedule 4 of the Housing (Scotland) Act 1988. The booking agreement grants guests the right to occupy the accommodation only for the agreed period. Holiday-makers agree not to sub-let or reassign the property to anyone else without consulting the owner and obtaining permission. The owner reserves the right to refuse to let the property to anyone deemed unsuitable. Guests are expected to respect and care for their accommodation during their stay, leaving it clean and tidy with a full inventory, and to take responsibility for minimising fire risk.
12. Smoking – Smoking is not permitted inside our property at any time. If you fail to observe this rule, we will bill you for any additional cleaning charges incurred.
13. “Force Majeure” – Force Majeure” – We cannot accept responsibility or pay any compensation when force majeure circumstances prevent or affect the performance or prompt performance of our contract with you. Force majeure circumstances include any event that we could not foresee or avoid, even with all due care. These circumstances include:
- Fire, explosion, flood, storm, or other weather damage destroying your holiday home (which we cannot reasonably remedy to a satisfactory standard before your holiday starts).
- Break-ins, criminal damage, or similar events.
- Adverse weather conditions
- Riots or civil strife
- Natural or nuclear disasters
- Industrial action.
- War or threat of war.
- Actual or threatened terrorist activity.
- Pandemics.
- All similar situations beyond our control.
In such events, we will offer you an alternative date if available. If we cannot offer an alternative or you do not wish to accept it, we will issue a credit note or refund all monies you have paid. Please note that all bookings from 2021 onwards acknowledge that Coronavirus is now here to stay.
14. Shortcomings – You must notify us immediately of any shortcomings with your accommodation so that we can take corrective action. If you fail to inform us of any complaint or claim during your holiday and do not write to us within 30 days after your holiday ends, we cannot accept liability for any shortcomings or claims of any nature.
